Terms and Conditions govern the use of services provided by Platinum Touch Design Studio, Inc. ("the Company") and constitute a legally binding agreement between the Company and its clients ("the Client"). By engaging in any business or services with Platinum Touch Design Studio, Inc., the Client agrees to adhere to these Terms and Conditions.
1. Services Offered:
Platinum Touch Design Studio, Inc. offers interior design and related services, including but not limited to space planning, material selection, 3D visualization, project management, and furniture procurement.
2. Engagement:
The Client agrees to formally engage Platinum Touch Design Studio, Inc. by signing a written agreement or contract. The agreement will outline the scope of services, project timeline, deliverables, and associated fees.
3. Fees and Payments:
The Client shall pay the agreed-upon fees as specified in the contract. A non-refundable deposit may be required before the commencement of any work. Payments shall be made according to the agreed schedule. Failure to make timely payments may result in project delays or termination.
4. Scope of Services:
The scope of services will be clearly defined in the written agreement. Any additional services not specified in the contract may be subject to additional charges and require a written amendment to the agreement.
5. Intellectual Property:
All designs, drawings, concepts, and other creative works produced by Platinum Touch Design Studio, Inc. are the intellectual property of the Company. The Client may use these materials solely for the intended project and may not reproduce, distribute, or use them for other purposes without the Company's explicit written consent.
6. Client's Responsibilities:
The Client shall provide accurate and complete information necessary for the project's successful execution. Any delays or errors resulting from incomplete or inaccurate information shall not be the responsibility of Platinum Touch Design Studio, Inc.
7. Project Timeline:
The project timeline will be outlined in the contract. While Platinum Touch Design Studio, Inc. will make reasonable efforts to meet deadlines, unforeseen circumstances or delays beyond the Company's control may affect the project timeline. In such cases, the Company will communicate promptly with the Client and make appropriate adjustments.
8. Confidentiality:
Both parties shall maintain the confidentiality of any sensitive information exchanged during the course of the project.
9. Client Satisfaction:
Platinum Touch Design Studio, Inc. will strive to meet the Client's expectations and provide high-quality services. If the Client is dissatisfied with any aspect of the service, the Company should be notified promptly so that reasonable efforts can be made to address the concerns.
10. Cancellation and Termination:
Either party may terminate the agreement by providing written notice. If the Client terminates the agreement before completion, the Company shall be entitled to compensation for the work completed up to the date of termination.
11. Limitation of Liability:
Platinum Touch Design Studio, Inc. shall not be held liable for any damages, losses, or expenses incurred by the Client or any third party arising from the services provided, except in cases of gross negligence or willful misconduct.
12. Governing Law and Jurisdiction:
These Terms and Conditions shall be governed by the laws of the United States of America, and any disputes shall be subject to the exclusive jurisdiction of the courts of the United States of America.
By engaging in business with Platinum Touch Design Studio, Inc., the Client acknowledges having read, understood, and agreed to these Terms and Conditions. These Terms and Conditions supersede any prior agreements, whether written or verbal, between the Client and the Company.
